Over the last two days, the U.S. Department of Commerce (Commerce) announced the final results of the agency’s nineteenth administrative review (AR19) of the antidumping duty order on certain frozen warmwater shrimp from Thailand and of the antidumping duty order on certain frozen warmwater shrimp from the Socialist Republic of Vietnam.
The 19th administrative review determines dumping margins for shrimp imported into the United States from Thailand and Vietnam between February 1, 2023 and January 31, 2024 (the “period of review”). These dumping margins are used to calculate the final amount of antidumping duties owed on those imports. The dumping margins also establish cash deposit rates applied to future imports of both Thai and Vietnamese shrimp.
With the issuance of the Thai shrimp AR19 final results, Commerce:
- maintained a preliminary finding that Thai Royal Frozen Foods Co., Ltd. did not sell shrimp into the U.S market during the period of review;
- increased the antidumping duty rate found for Thai Union Group Public Co., Ltd. from a preliminary rate of 1.28 percent to 2.01 percent;
- reduced the antidumping duty rate assigned to Charoen Pokphand Foods Public Co., Ltd. – which had refused to provide information requested by the federal agency – from a preliminary rate of 57.64 percent to 17.38 percent; and
- assigned the thirteen other Thai shrimp exporters covered by the administrative review but not individually examined an antidumping duty rate of 2.01 percent.
Prior to Commerce’s issuance of the final results in the 19th administrative review, most Thai shrimp exporters were shipping to the United States with a cash deposit rate of between 0.51 percent and 1.23 percent. Once the federal agency’s final results are formally published in the Federal Register, likely next week, the cash deposit rate for future imports of Thai shrimp will increase and U.S. Customs and Border Protection will be instructed to collect additional amounts owed on Thai shrimp imports entered into the United States during the period of review, plus interest.
With the issuance of the Vietnamese shrimp AR19 final results, Commerce:
- increased the antidumping duty rate assigned to Thong Thuan Co., Ltd. from a preliminary rate of 0.99 percent to 25.76 percent;
- reduced the antidumping duty rate assigned to Soc Trang Seafood Joint Stock Co. (STAPIMEX) from a preliminary rate of 35.29 percent to 25.76 percent; and
- assigned the twenty-two other Vietnamese shrimp exporters covered by the administrative review that demonstrated independence from the Vietnamese government but were not individually examined an antidumping duty rate of 4.58 percent and a cash deposit rate going forward of 4.28 percent.
Prior to Commerce’s issuance of the final results in the 19th administrative review, most Vietnamese shrimp exporters were shipping to the United States without any requirement of a cash deposit. When these results are published in the Federal Register, a cash deposit requirement for future imports of Vietnamese shrimp will be imposed and U.S. Customs and Border Protection will be instructed to collect additional amounts owed on Vietnamese shrimp imports entered into the United States during the period of review, plus interest.
“The American shrimp industry is grateful to the U.S. Department of Commerce for confirming that foreign shrimp exporters increased their dumping while prices in the U.S. market were collapsing,” said Blake Price, director of the Southern Shrimp Alliance. “It is, however, incredibly frustrating to see international financial institutions, like the Asian Development Bank, direct funds to shrimp exporters, like Thai Union, found to be unfairly-trading in our market.”
