This week, U.S. Customs and Border Protection (CBP) published information regarding the annual distribution under the Continued Dumping and Subsidy Offset Act (CDSOA) for fiscal year (FY) 2023. In total, CBP reports that just $3,870.02 in antidumping duties collected on shrimp imports was distributed through the CDSOA program this year. This represents a substantial decline from the $339,684.11 in antidumping duties collected on shrimp imports in FY 2022 and the $57,768.45 distributed through CDSOA in FY 2021.
Only antidumping duties collected on imports of shrimp entered into the country before October 1, 2007 are distributed through the CDSOA program. All antidumping duties collected on imports of shrimp entered on or after October 1, 2007 are deposited in the U.S. Treasury and are not subsequently distributed through the CDSOA program.

In total, CBP reported that roughly $18.7 million under the CDSOA program was made available for distribution in FY2023. The majority of those funds, totaling $11.9 million, relates to the antidumping duty order on fresh garlic from China.
Per CBP’s reporting, since FY 2006, over $272 million in antidumping duties have been distributed to the shrimp industry through CDSOA. The total amount of duties collected on shrimp imports and distributed through CDSOA is summarized in the chart below:
Although funds will continue to be distributed, in diminishing amounts, under the CDSOA program until all duties on shrimp import entries made before October 1, 2007 are collected by CBP, all of the funds held in CDSOA clearing account balances on all antidumping duty orders, including those on shrimp, have now been exhausted as the agency has now processed every import entry subject to CDSOA.
