Today, the Federal Register published U.S. Customs and Border Protection’s (“CBP”) “Notice of Intent to Distribute Offset for Fiscal Year 2018.” Per the notice, certifications for fiscal year 2018 distributions of Continued Dumping and Subsidy Offset Act (“CDSOA”) funds must be received by the agency by July 30, 2018.
CBP has not yet released its preliminary report regarding CDSOA funds that may be available for distribution in fiscal year 2018. However, on November 29, 2017, CBP reported that there was a total of $690,281.26 deposited in clearing accounts related to the shrimp antidumping duty orders at the end of fiscal year 2017. A year earlier, CBP reported that there was a total of $1,194,360.86 deposited in clearing accounts related to the shrimp antidumping duty orders at the end of fiscal year 2016. The agency ultimately distributed a total of $489,058.16 in CDSOA funds from antidumping duties collected on shrimp imports in fiscal year 2017. It is unclear what amount – if any – of CDSOA funds from antidumping duties collected on shrimp imports may be ultimately distributed in fiscal year 2018.
Distributions to the shrimp industry from the CDSOA program began in fiscal year 2006. Over the last twelve years, $268,569,340.72 in collected antidumping duties on shrimp imports have been made available for distribution to the shrimp industry through CDSOA.
